Sean Puckett the New Zealand born conman has tried to avoid his debt by declaring
bankruptcy but he may have outsmarted himself. What Sean doesn't realize is that
because he obtained the money by fraud he is still legally liable for it and may now end
up in prison.

Subsection 153(2)(b) of the Bankruptcy Act does not release a former bankrupt from
debts incurred through fraud. A debt incurred by fraud is not specifically irrecoverable
under the A New Tax System (Administration) Act 1999, as the onus is on the debtor to
prove that the debt did not occur because of fraud.
